General conditions of Sale
These General Conditions of Sale apply to all sales made by PROTEL Roberto Anzelmo Srl ("PROTEL") in Italy.
The contract is concluded at the time of notification of the order by PROTEL, by sending written confirmation to the customer. The underwriting result in the automatic membership of the Order of the Customer to the General Conditions of Sale.
No amendment to the Purchase must be made in writing. PROTEL assumes no obligation if the change request is made by the customer after the shipment of the product.
1. PRICE AND PAYMENTS
The selling price of the products and terms of invoicing and payment are those indicated by PROTEL upon acceptance of the Purchase Order. Price is ex works and VAT excluded. The customer has the right to confirm or reject the order in case the price indicated in the order form appears different from that stated in the order confirmation.
2. DELIVERY PRODUCTS and FREE COURIER
The transfer of risks related to the transport of products sold takes place when shipped from warehouses PROTEL, as required by Article 1510 of the Civil Code.
Insurance of packages is always excluded. And 'to the customer who must make an explicit request when ordering.
The customer must refuse the neck when the receiving box is damaged.
PROTEL accepts no responsibility for the case of late delivery.
3. ALLEGATION OF FLAWS
Every product is Protel colludato before sending to the client to ensure proper operation.
The customer must report any defects and / or defects in the
products supplied or any failure and / or uneven delivery of all or part of the Purchase Order within a period of 8 (eight) days, respectively, to be calculated from the date of discovery of defects or defects and / or the delivery of products subject to revocation. In the case of obvious defects the complaint must be made within 8 (eight) days of delivery. The complaint must be made in writing by registered letter
After sending the complaint in the term, the Customer shall permit PROTEL examine products to establish the existence of defects denounced and make the appropriate changes and repairs.
The Client will refrain from any further action on the products themselves or lose the guarantee.
The return of products is provided in each case subject to the prior written consent of PROTEL. The costs and risks of return are borne by the customer.
In the event that the customer is due a refund as a result of product returns, the amount thereof is calculated with reference to the current prices for the same products at the time of their arrival at PROTEL, reduced on the basis of the depreciation arising from the state and the age of the returned products.
The products sold by PROTEL are guaranteed for 24 months from the date of their delivery to the customer due to defects or manufacturing defects and is limited to the replacement or repair of products recognized as defective excluding any right to compensation. Transport costs will be borne solely by the customer. The guarantee does not apply to replacement, repair or maintenance that are required because of normal wear and tear or in case of malfunctions resulting from negligence, carelessness or inexperience in the use and / or installation of the products. The guarantee does not operate in case the customer has carried out or did carry out third party product, without the prior written consent of PROTEL.
6. RIGHT OF WITHDRAWAL
In compliance with the new code of consumption transposing the Legislative Decree 21 of 21 February 2014 concerning the enhanced protection of consumers, Protel adheres to the following products: RF connectors, antenna internet key mod. Arkey, brackets mod. zafz25 / 90C and zafz25 / 114C and headed for radio frequency coaxial cables with standard sizes listed on the website (not part of systems).
Remain free of all other products as they are made at the express request of the customer specific frequency, as expected dall'Art.59 of the Consumer Code.
The customer can exercise the right of withdrawal within 14 days prior notice by registered letter with acknowledgment of receipt or certified mail.
The goods must be made in the 'original packaging and without defects of any kind, carriage paid at the registered Protel Cesano Boscone.
7. REPAIRS OUT OF WARRANTY
Outside the warranty period, repairs are subject to the express written acceptance by the customer of the estimate of repair costs. Transport costs will be borne solely by the customer. The reparation payments to be made to notice goods delivery.
8. COURT EXCLUSIVE JURISDICTION
These General Conditions of Sale are governed by the laws of the Italian Republic. Anything not expressly
governed by these conditions, it will apply the rules of the Civil Code.
Any dispute arising out of contracts governed by these Terms of Sale shall be referred exclusively to the Court of Milan.
